Who are we and what does this page cover?
Yacht Hire Saint-Tropez operates the website yachthiresainttropez.com and arranges crewed yacht and boat charters in Saint-Tropez, from day charters to longer charters, across a range of vessels from day-boats to superyachts. Day rates start from €1,700, and the exact price of your charter is always set out in a written quote before you book.
These terms govern the contractual relationship between you, the client, and Yacht Hire Saint-Tropez for any charter arranged through our website, by email, phone or WhatsApp. They do not cover privacy matters, which are set out in our separate privacy policy.
How does an enquiry become a confirmed booking?
A booking does not happen automatically when you fill in a form or send a message. You contact us through the enquiry form, by email, phone or WhatsApp, telling us the yacht you are interested in (if any), your preferred dates and the number of guests.
We reply with a written quote covering the yacht, dates, price and what is included. The charter is only confirmed once we have sent you written confirmation and, for day charters, received full payment, or, for charters of two days or more, received a 50% deposit. No booking exists before that written confirmation, whatever was discussed beforehand.
What is included in the price, and what is paid separately?
The price shown in your written quote is the price of the charter itself: the yacht, crew and the inclusions stated in that quote. It does not automatically include fuel, marina fees, the advance provisioning allowance (APA) charged on larger yachts, catering or other extras.
Any such extras are listed in your written quote before you confirm the booking. We do not add any charge that was not quoted to you in writing.
How and when do you pay?
Day charters are confirmed only once paid in full. Charters of two days or more are confirmed once we receive a 50% deposit; the balance is payable as set out in your written quote. Bookings are not paid online through the website itself; payment is arranged directly with us once your quote is agreed.
If we agree a cancellation refund with you, it is processed within 14 business days and returned to the original payment method.
What if you need to cancel or change the booking, and what if we have to cancel?
Because a yacht charter is a leisure service booked for a specific date, the 14-day right of withdrawal that applies to most distance contracts does not apply here. This is set out in Article 16(l) of Directive 2011/83/EU and, in French law, in Article L221-28 of the Consumer Code. In place of that statutory right, we apply the voluntary cancellation policy below.
If you cancel more than 7 days before departure, you receive a full refund. If you cancel between 48 hours and 7 days before departure, you receive a 50% refund. If you cancel less than 48 hours before departure, no refund is due. Any refund due is processed within 14 business days to the original payment method. Changes to dates or guest numbers are handled the same way as a cancellation if the original slot cannot be reused.
We may cancel or postpone a charter if the captain or the port authority considers the conditions unsafe, or because of a technical problem with the vessel, or for other reasons beyond our control. In any of these cases, you choose between a free new date and a full refund; there is no cost to you. The captain's decision on safety is final and is not open to negotiation on the day.
Who decides how many guests can board, and who is in charge on the water?
The number of guests on board can never exceed the vessel's licensed capacity, whatever the age of each guest. This limit exists for safety reasons and is not negotiable on the day of the charter.
The captain is in command of the vessel at all times. The crew may refuse to let anyone board, or may ask anyone to disembark, if that person's presence endangers the safety of the vessel, the crew or other guests. The captain also decides the itinerary on the day, taking into account weather, sea conditions, port rules and the time available; any itinerary discussed in advance is indicative and may be adjusted by the captain for safety or practical reasons.
What is expected of you and your guests on board, and who pays for damage?
You and your guests are expected to follow the crew's instructions, particularly on safety matters, and to respect the vessel and its equipment. The captain may end the charter early, without refund for the remaining time, if guests behave in a way that endangers the vessel, the crew or other people on board.
You are responsible for damage caused by you or your guests to the yacht, its equipment or its tenders and water toys, beyond normal wear and tear. Personal belongings brought on board remain your own responsibility at all times; we do not accept liability for items lost, damaged or left behind on the vessel.
What are the limits of our liability?
We arrange your charter with care, but sailing involves conditions that no one fully controls. We are not liable for delays, changes or cancellations caused by weather, sea conditions, port or harbour-master decisions, technical faults discovered on the day, or other circumstances beyond our reasonable control. In those cases, the remedy is the free new date or full refund described above.
Our liability, where it does arise, is limited to the price paid for the charter concerned. Nothing in these terms excludes liability that cannot lawfully be excluded.
What if you have a complaint, and how do we handle the website itself?
If something about your charter was not as agreed in the written quote, tell us as soon as possible, ideally while the crew can still address it, and in any case by writing to [email protected] afterwards with the booking details and what went wrong. We will look into it and reply directly.
The content of yachthiresainttropez.com, including yacht descriptions, photographs and pricing information, is provided to help you choose a charter and is not a contractual offer in itself; the written quote is what counts. You may browse and use the site to make enquiries, but you may not copy or reuse its content for commercial purposes without our agreement. For clients planning an active day on the water, the brokerage matches vessel choice to tender range and water-toy capacity at the booking stage, so paddleboard, snorkel and towable storage are confirmed with your quote rather than discovered on the dock.
Which law applies, and can these terms change?
These terms, and any booking made under them, are governed by French law. Any dispute that cannot be resolved directly with us is subject to the jurisdiction of the French courts.
We may update these terms from time to time, for example to reflect a change in our booking process. The version published on yachthiresainttropez.com at the time you make your enquiry is the one that applies to your booking; any later change does not affect a charter already confirmed in writing.
